The Supreme Court will hear the challenge to abrogation to Article 370 before the constitution Bench of 5 judges.
The Supreme Court bench today Chief Justice of India, Ranjan Gogoi, Justices SA Bobde and S Abdul Nazeer heard at least eight petitions challenging the actions of the Modi government and issued notice to the Union government.
This came despite stiff opposition by the government’s legal team, Attorney General KK Venugopal and Solicitor General Tushar Mehta.
AG KK Venugopal cautioned the court saying the matter is a very sensitive one, “Anything that is said here is taken to the United Nations .. The matter has grave cross border implications.”
Both Attorney General and Solicitor General told the court that they have no official notice issued to them, therefore the court issued notice to the central government.
When the Government’s legal team asked the Top court to reconsider it’s order, CJI Ranjan Gogoi said that the Bench will not change the order passed by it.
The matter will now be heard in the first week of October.
PIL Lawyer ML Sharma, Kashmiri lawyer Shakir Shabir, two Lok Sabha MP’s Mohammad Akbar Lone and Hasnain Masoodi, Supreme Court lawyer from J&K Soayib Qureshi and Retired Military Officers and bureaucrats — Radha Kumar, Hindal Haidar Tyabji, Air Vice Marshal (Retd) Kapil Kak filed petitions in the Supreme Court challenging the scrapping of Article 370 via the Presidential Order.
